The Impact of Emergency Federal Intervention on the Autonomy of Federal Units (A State of Emergency as Case Study)

Abstract
Declaring a state of emergency is one of the most prominent and influential means of federal emergency intervention in the structure of the federal state, due to the temporary redistribution of powers between the federal authority and the units, and the impact this has on the autonomy of the latter. In this context, the study reveals that most studies have focused on examining the declaration of a state of emergency from the angle of protecting security and the impact on rights and freedoms, without extending to examining its impact on the autonomy of federal units. Based on this research gap, the study adopts a comparative analytical approach to examine the legal organization of declaring a state of emergency and its practical applications, and its impact on the autonomy of units, in three federal systems in which the philosophy of the legislator and the degree of this autonomy differ: (the United States of America, India, and Iraq) within two related criteria: the first is the direct impact of declaring a state of emergency on the autonomy of units, and the second is the effectiveness of constitutional and oversight guarantees in limiting the federal authority’s deviation in using this exceptional measure or normalizing it. The study concluded that the American constitutional system shows a tendency to normalize and politicize the declaration of a state of emergency due to the expansion of legislative authorization and the multiplicity of sources of emergency powers, which is indirectly reflected in the autonomy of federal units. In India, the ambiguity of some constitutional texts and the expansion of others, coupled with the experience of the 1975-1977 state of emergency declaration, contributed to highlighting the tendency towards centralization and the expansion of the impact of the state of emergency on the autonomy of the units, which necessitated the introduction of subsequent constitutional amendments. In Iraq, the absence of a complementary legislative regulation that regulates the provisions of the declaration of a state of emergency contributed to weakening the effectiveness of the constitutional text and the ambiguity of the potential impact of using the state of emergency declaration to undermine the autonomy of the region. Accordingly, the study calls for the development of a legal framework that regulates the declaration of a state of emergency in a federal context based on a balance between the requirements of necessity and the preservation of the autonomy of the units.
