Main Article Content
Abstract
Objective: To determine how the culture of informality among citizens generates legal contingencies in the transfer of minor vehicles in the district of San Martín.
Method: A qualitative methodological approach was used, with a descriptive research type and a phenomenological design, employing documentary analysis as the technique and an analysis sheet as the instrument, based on scientific articles indexed in Scopus, Scielo, and Redalyc.
Results: It was considered that informality not only responds to economic factors, but also refers to naturalized sociocultural mechanisms and institutional weakness, all of which legitimize the omission of legal requirements such as, for example, registration and notarial formalization; Therefore, legal uncertainty, conflicts over property rights, fraud, and civil liabilities towards third parties are generated.
Conclusion: The culture of informality in the transfer of minor vehicles is a structural phenomenon that undermines legal certainty and requires interventions that respond to systemic recommendations, such as institutional strengthening, administrative simplification of the vehicle registration management bodies, and citizen legal education
